Process May Buy Time For Rector

GUAM - Monte Mesa will have to resubmit his complaint against Senator Matt Rector if the Guam Legislature's Committee on Ethics and Standards (CES) adopts the proposed Rules of Procedure that Minority Counsel Thomas Fisher submitted today at the second CES meeting.

All Complaints Must Be Signed Under Oath

Section 6(a) of the draft Rules states, "a complaint may be filed in any written form as long as it is signed under oath, pursuant to Guam law and under pain of perjury and filed with the Committee Chair or her designee." If this section of the rules is adopted Mesa will have to submit a notarized complaint to CES Chair Judi Guthertz, instead of Speaker Judi Won Pat, to whom his original letter was addressed.

While the Committee may want to proceed as quickly as possible, the draft rules submitted today could slow things down.

The proposed rules may determine that Mesa's complaint is defective, thereby forcing him to start all over again.

If the CES adopts a set of rules that requires an individual wishing to make an ethics complaint to jump through too many hoops, it could discourage them from filing. However, the CES is duty bound to adopt and establish an objective set of rules. These rules will be used to judge their peers in the setting of an investigatory panel. Ideally, they should also become an effective yardstick for every senator to measure their own potential conflicts. Finally, the new rules should also serve as a firm foundation for future ethics panels.

This could be a long process, Guam. Better grab some popcorn and get comfortable.

How can Mr. Mesa submit his complaint to the committee when none was
established at the time. Another tatic to keep a useless wantabe senator. Same
ol'sh#t, and only on GUAM. Uncle Federales please come and take over my island,
the natives and wannabe natives are running a muck!!!
